Terms of service

Last updated: September 25, 2026

Welcome to Third Act Media Distribution. The terms “we,” “us,” and “our” refer to Third Act Media Distribution. We operate this store and website, including the information, content, features, tools, products, and services offered through them (the “Services”). The Services are hosted by Shopify.

These Terms of Service, together with the policies they refer to, describe your rights and responsibilities when you use the Services. Please read them carefully. They include warranty disclaimers and limits on liability.

By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.

1. Access and account

You represent that you are at least the age of majority in your place of residence. If you allow a minor to use the Services on a device you own or manage, you are responsible for that use.

To browse, create an account, or buy, you may need to provide information such as your email address and billing, payment, and shipping details. You represent that the information you provide is correct, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.

2. Our products

We try to show our products accurately. Colors and appearance can differ from your screen because of your device and its settings. We do not warrant that a product will look the same as it does in the store or will meet your expectations.

Product descriptions may change at any time without notice. We may discontinue a product, or limit how many of a product we sell to any person, region, or jurisdiction, at our discretion.

3. Orders

When you place an order, you are offering to buy. We may accept or decline an order for any reason. An order is not accepted until we confirm it. We must receive and process your payment before we accept an order. Review your order before you submit it. We may be unable to cancel an order after we accept it. If we do not accept an order, or we change or cancel it, we will try to reach you using the email, billing address, or phone number you provided.

Purchases are subject to our Refund Policy. All sales are final, except as that policy describes for an item that is defective, damaged in transit, or not what you ordered.

Unless you are buying under an approved wholesale or business account, you represent that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and billing

Prices, discounts, and promotions may change without notice. The price you pay is the price in effect when you place the order, as shown in your order confirmation. Unless we say otherwise, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices in this store may differ from prices in other stores. A promotion may have its own terms. If those terms conflict with these Terms, the promotion terms control.

You agree to give current, complete, and accurate purchase, payment, and account information, and to update it when it changes, including your email address and payment-card details.

You represent that the payment information you provide is true and complete, that you are authorized to use that payment method, that your card issuer or payment provider will honor the charges, and that you will pay the posted price plus shipping, handling, and applicable taxes.

5. Shipping and delivery

We are not liable for shipping or delivery delays. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we transfer the products to the carrier. Shipping is also described in our Shipping Policy.

6. Intellectual property

The Services, including trademarks, brands, text, images, graphics, video, audio, and the design and arrangement of the Services, are owned by Third Act Media Distribution, its affiliates, or its licensors and are protected by intellectual property laws. Product names and images may also belong to their respective rights holders.

These Terms let you use the Services for your personal, non-commercial use, and, if you have an approved wholesale account, to operate that account. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material on the Services without our prior written consent, except as these Terms allow. Nothing in these Terms grants you a license under any patent, trademark, copyright, or other intellectual property of Third Act Media Distribution, Shopify, or any third party, except the limited right to use the Services. All rights not expressly granted are reserved.

You may not use our names, logos, product names, designs, or slogans without our prior written permission. Shopify’s name, logo, and product names are trademarks of Shopify. Other names and logos on the Services belong to their respective owners.

7. Optional tools

We may give you access to customer tools offered by third parties. We do not monitor or control those tools. We provide access to them “as is” and “as available,” without warranties or endorsement. We are not liable for your use of them. Your use of a third-party tool is at your own risk, and you should read that provider’s terms.

New features we add to the Services are part of the Services and are subject to these Terms.

8. Third-party links

The Services may link to third-party websites or include third-party features. We do not control, and are not responsible for, those sites or their content. If you leave the Services, you do so at your own risk. Questions about a third party’s products or services should be directed to that third party.

9. Relationship with Shopify

Third Act Media Distribution is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Third Act Media Distribution. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Third Act Media Distribution, including any injury, damage, or loss resulting from purchased products or services. You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Third Act Media Distribution.

10. Privacy Policy

Personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because Shopify hosts the Services, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and with third parties that may be located in countries other than where you live. Our Privacy Policy describes how we, Shopify, and our partners use your personal information.

11. Feedback

If you submit ideas, suggestions, feedback, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use. We may use that license to operate, provide, evaluate, and improve the Services and to perform these Terms.

You represent that you own or have the rights to the Feedback, that you have disclosed any compensation you received for submitting it, and that the Feedback complies with these Terms. We do not have to keep Feedback confidential, pay you for it, or respond to it.

We may monitor, edit, or remove Feedback that we believe is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates someone’s intellectual property or these Terms. You agree that your Feedback will not violate a third party’s rights, will not be unlawful or abusive, and will not contain malware. You may not use a false email address or mislead us about who you are. You are responsible for your Feedback. We are not liable for Feedback posted by you or anyone else.

12. Errors

The Services may contain typographical errors or mistakes in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct any error and may change information or cancel an order if information was inaccurate, including after you submit the order, without prior notice.

13. Prohibited uses

You may use the Services only for lawful purposes. You may not use the Services: (a) for an unlawful or malicious purpose; (b) to violate any law or regulation; (c) to infringe our or anyone else’s intellectual property; (d) to harass, abuse, harm, defame, or intimidate any person; (e) to send false or misleading information; (f) to send or reuse material that does not comply with these Terms; (g) to send junk mail, chain letters, spam, or similar solicitations; (h) to impersonate any person or entity; or (i) to restrict anyone’s use of the Services or expose us, Shopify, or other users to liability.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) copy, sell, resell, or exploit any portion of the Services except as these Terms allow; (c) collect or track other people’s personal information; (d) phish or pretext the Services; (e) use a robot, spider, scraper, automated process, or AI tool to access the Services; or (f) bypass security, authorization, or robot-exclusion measures. We may suspend or terminate your access at any time, without notice, if we determine that you have violated these Terms.

14. Agents

This section applies if you use, allow, or cause an Agent to access the Services. “Agent” means software or a service that takes autonomous or semi-autonomous action for a person or entity, including on that person’s device, without direct supervision.

No Agent may access the Services unless it identifies itself and follows this section. An Agent may not access the Services if we have asked it not to. We may limit, including by technical measures, whether and how an Agent accesses the Services.

An Agent must: (i) identify itself in every HTTP or HTTPS request by including “Agent/[agent name]” in the user-agent string; (ii) not hide that the request comes from an Agent, including by mimicking a person or by completing or bypassing a CAPTCHA or similar test; (iii) answer truthfully if asked whether the interaction is from a person or a computer; and (iv) not circumvent a measure that controls Agent access.

15. Termination

We may end this agreement or your access to the Services at any time, without notice. You remain liable for amounts due through the termination date.

These sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and entire agreement, Assignment, Governing Law, Privacy Policy, and any provision that by its nature should survive.

16. Disclaimer of warranties

Information on the Services is for general information. We do not warrant that it is accurate, complete, or useful. You rely on it at your own risk.

EXCEPT AS WE EXPRESSLY STATE, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PROVIDED BY LAW, THIRD ACT MEDIA DISTRIBUTION, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY.

18. Indemnification

You agree to indemnify, defend, and hold harmless Third Act Media Distribution, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, and claims, including reasonable attorneys’ fees, payable to a third party arising out of (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or third-party right, or (3) your access to and use of the Services.

We will notify you of an indemnified claim. A delay in notice relieves you only if you are materially prejudiced. We may control the defense and settlement at your expense, including choice of counsel, but we will not settle a claim that imposes a non-monetary obligation on you without your consent, which you may not unreasonably withhold. You will cooperate in the defense, including by providing relevant documents.

19. Severability

If a provision of these Terms is held unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable part will be severed. The rest of these Terms will remain in effect.

20. Waiver and entire agreement

Our failure to enforce a provision is not a waiver of that provision.

These Terms and any policies or operating rules we post are the entire agreement between you and us about the Services. They replace prior agreements and communications about the Services, including earlier versions of these Terms. Ambiguities will not be construed against the drafting party.

21. Assignment

You may not delegate, transfer, or assign these Terms or your rights or obligations without our prior written consent. Any attempt to do so is void. We may transfer, assign, or delegate these Terms and our rights and obligations without notice to you.

22. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. You and Third Act Media Distribution consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of New York.

23. Headings

Headings are for convenience only and do not affect these Terms.

24. Changes

The current Terms of Service are always available on this page. We may update these Terms by posting the new version on our website. It is your responsibility to check for changes. We will notify you of material changes as required by law, and those changes take effect on the date stated in the notice. Your continued use of the Services after we post changes is acceptance of the changes.
